Diane, Did you know that an appeal only has about a 4% chance of succeeding. In this particular case, the decision to appeal becomes a little tougher for 2 reasons. First, Greenwood asked for relief. The courts feel like a 11.9 million dollar settlement is a considerable amount of relief. Then the court dropped the &quot;commerce clause&quot; bomb on us...we didn&#039;t just violate some obscure rule of law, we decided to take on the U.S. Constitution... So, should we appeal the Court’s deci­sion regard­ing quarry trucks being able to use 2nd Avenue?&quot; Personally, I&#039;d have to think twice before I did. It is a huge decision.</description>
